ICAN Education ("we", "us", "our") respects your privacy and is committed to protecting the personal information of the families, students, and visitors we serve. This Privacy Policy explains what information we collect, how we use it, when we share it, and the rights you have regarding your personal information.
We comply with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), Ontario's Consumer Protection Act and applicable education and children's privacy standards, and — where it applies to visitors from those jurisdictions — the EU/UK General Data Protection Regulation (GDPR/UK GDPR), the Children's Online Privacy Protection Act (COPPA), and the California Consumer Privacy Act (CCPA/CPRA).
1. Who this policy applies to
This policy applies to information collected through our website, landing pages, WhatsApp and email communications, phone calls, assessments, and in-centre tutoring services operated by ICAN Education in Ajax, Ontario, Canada.
2. Information we collect
Information you provide directly
- Parent/guardian name, email address, phone number and WhatsApp number
- Student's first name, grade level, school, and general academic needs or goals
- Preferred program, subjects, scheduling preferences and referral source
- Assessment results, tutor notes and progress reports generated during our services
- Messages you send us via forms, email, WhatsApp or phone
Information collected automatically
- Device and browser information, IP address, approximate location, pages viewed, and referring URL
- Cookies, pixels and similar technologies (see Section 7)
Information from third parties
- Advertising and analytics platforms (e.g., Meta/Facebook Pixel, TikTok Pixel, Google) that report ad performance and audience insights
- Referrals from existing families with your consent
3. Children's information
Our services are designed for children in K–12. We do not knowingly collect personal information directly from a child under the age of 13 without verifiable parent or guardian consent. Parents and guardians provide student information on behalf of their child and may review, update or request deletion of that information at any time by contacting us.

- Respond to inquiries and book free assessments
- Deliver and improve our tutoring programs and services
- Communicate program updates, scheduling, and account-related information
- Send marketing communications where you have opted in (you can unsubscribe at any time)
- Measure the performance of our website and advertising campaigns
- Comply with legal, tax, accounting and regulatory obligations
- Detect, prevent and respond to fraud or misuse
5. Legal basis for processing (GDPR/UK GDPR)
Where GDPR applies we rely on the following legal bases: your consent (marketing, non-essential cookies), performance of a contract (delivering tutoring services), our legitimate interests (improving services, securing our systems, measuring advertising), and legal obligations.
6. When we share information
We do not sell personal information. We share it only with:
- Service providers that help us operate — for example hosting, database, email, SMS/WhatsApp messaging, analytics and advertising platforms — under contracts that require appropriate safeguards
- Our tutors and staff who need it to deliver your program
- Authorities or advisors when required by law, subpoena, or to protect our rights and the safety of students and staff
- A successor in the event of a merger, acquisition or sale of assets, subject to this policy
7. Cookies and tracking technologies
We use strictly necessary cookies to run the site and, with your consent where required, analytics and advertising cookies including the Meta/Facebook Pixel and TikTok Pixel to measure ad performance and show relevant content. You can control cookies through your browser settings and opt out of interest-based ads through YourAdChoices.ca or optout.aboutads.info.
8. Data retention
We keep personal information only as long as needed for the purposes described in this policy, to deliver our services, and to meet legal, tax and accounting obligations. When information is no longer needed we securely delete or anonymize it.
9. Security
We use administrative, technical and physical safeguards appropriate to the sensitivity of the information, including encryption in transit, access controls, and vetted service providers. No system is 100% secure, so we cannot guarantee absolute security.
10. International transfers
Some of our service providers store or process data outside Canada (including in the United States and the European Union). Where required we use contractual safeguards such as Standard Contractual Clauses to protect your information.
11. Your rights
Subject to applicable law, you have the right to:
- Access the personal information we hold about you or your child
- Correct information that is inaccurate or incomplete
- Withdraw consent or delete your information
- Object to or restrict certain processing
- Request a copy of your information in a portable format
- File a complaint with a privacy regulator, such as the Office of the Privacy Commissioner of Canada or the Information and Privacy Commissioner of Ontario

12. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above and, where changes are material, provide a more prominent notice.
